By downloading, installing, or using Near ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Near is an iOS application that allows you to create countdowns to meaningful life events and transform them into memory capsules after the events occur. The App stores data on your device and optionally syncs via your private iCloud account.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms and the Apple App Store Terms of Service.
You may not:
Near is fully usable without an account. You may optionally sign in with Apple from the Settings screen to enable personalization and to prepare for future features like named participants in shared countdowns. Signing in stores your name, email, and Apple user identifier on your device only; this information is never transmitted to any server.
You may sign out or permanently delete your Near account at any time from Settings. Deleting your account removes your profile data from your device. Your moments are independent of your account and are not affected by account deletion.
Near offers optional auto-renewing subscriptions ("Near+") that unlock additional features:
Subscriptions are managed entirely through your Apple ID and the App Store. Payment is charged to your App Store account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your device's Settings > Apple ID > Subscriptions.
Prices are in United States dollars and may vary by region. Prices are subject to change, though any price change will not affect active subscription periods.
Near also offers a one-time "Lifetime" purchase of Near+ for $9.99. This is a non-consumable in-app purchase that grants permanent access to all Near+ features, including future feature additions. Refunds for lifetime purchases are handled by Apple in accordance with Apple's refund policy.
The App, including its design, code, graphics, icons, and content, is the intellectual property of Near and is protected by copyright and other intellectual property laws. All rights not expressly granted in these Terms are reserved.
Your content — the moments, photos, and notes you create within the App — remains yours. We claim no ownership over your personal content.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant that any data stored locally or in iCloud will be preserved indefinitely.
To the maximum extent permitted by applicable law, in no event shall Near, its developer, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the App.
Our total liability for any claim arising from or relating to these Terms or the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
Upon termination, your license to use the App will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
